The lock washers were the problem. Don't use them.

You'll probably get away with it... until one fails... than you'll probably be wishing you'd changed them ;)

I have the original Service Information 26 002 83 (in PDF).
The new length is 13 mm (14,5 mm before).
BMW says to renew the bolts each time (tighten at 40 Nm torque).

Having been in the auto repair industry since I was lad at 18 years I can tell you I have seen the results of people who re use bots that are listed as stretch or torque to yield and should not be re used, believe it change them they are not expensive and you will have peace of mind, touque to the specs in the manual you will need a special attachment for your torque wrench, for me I made my own.

And yes I used the new bolts that did not need washers.

OK so I have just replaced mine with the new short bolts, but the Clymer service manual says 23 to 25 Nm Torque, are you sure as if so I will need to re tighten before I put the battery box and sub frame back on my R80.

Should be 29 ft-lbs. Converting 25NM times about 0.74 gives ft-lbs which is too low. It's a little tough to get a torque wrench in that location. Generally, using blue Loctite on the bolts, take the box wrench in the tool kit and use a rag in the palm of your hand and give it a good grunt. Should be good to go.

I shove a wooden axe handle or some such thing thru the wheel to prevent it moving...then crank down on the locktit bolt with the 12 pt spanner as hard as I can. Kurt describes it well.

Earlier in the thread, someone mentioned Bulletin 2078. Here is a screenshot of that bulletin...
